Terms of Service — Lafai

These Terms govern your use of the Lafai mobile application ("Lafai"). By downloading, accessing, or using the app, you agree to these Terms. If you do not agree, do not use the App.

1. Software

Lafai is provided on an "as is" and "as available" basis. Features and availability of backend APIs are not guaranteed. We may update, alter, or remove features at our discretion to improve the service.

2. Not Medical or Dietary Advice & AI Disclaimer

Not Medical Advice: The App uses artificial intelligence to read food labels and provide ingredient and nutritional information based on public guidelines (FDA, AHA, WHO). The App does not provide medical diagnosis, treatment, or professional dietary advice. The information provided should not replace consultation with a qualified healthcare provider or nutritionist. Always verify critical allergen or ingredient information on the physical product label. Do not rely on Lafai for allergy-critical or health-critical decisions.

Accuracy of artificial intelligence

Lafai uses a third-party artificial intelligence service (the Google Gemini API) to analyze product labels and generate nutritional insights. While we strive for accuracy, AI systems can occasionally produce incorrect, incomplete, or misleading information ("hallucinations"). The insights provided by Lafai are for informational purposes only. You agree to independently verify any critical allergy or health information directly from the product manufacturer. Lafai and its developers are not liable for any health consequences resulting from reliance on AI-generated information.

3. Subscriptions, Purchases, and Fair Usage Policy

In-App Purchases and Subscriptions: Lafai offers optional paid features, including credit packs and auto-renewing Premium subscriptions.

• Billing: Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Cancellation: You can manage and cancel your subscriptions by going to your App Store or Google Play Account Settings after purchase. Deleting the Lafai application does not cancel your subscription.
• Refunds: All payments are processed entirely by the App Store Provider (Apple or Google). Therefore, we cannot process refunds directly. Any refund requests must be directed to Apple or Google customer support.
• Credit Packs (Consumables): Because you use Lafai anonymously, any purchased credit packs are tied directly to your current device installation. Credit packs cannot be restored if you uninstall the application, lose your device, or switch to a new device. Premium subscriptions, however, are tied to your Apple ID or Google Play account and can always be restored.

Fair Usage Policy (FUP)

Our Premium subscriptions offer "unlimited" access intended for normal, manual, daily use by a single human user. To ensure optimal performance, service quality, and fair access for all customers, we employ a Fair Usage Policy.

"Unlimited" refers to the unrestricted use of features within the bounds of what a highly active, regular user would reasonably consume. We reserve the right to monitor usage. If an account's usage significantly exceeds average human patterns (e.g., automated scraping, bot-like behavior, account sharing, or generating requests at a volume that degrades the experience for other users), we may, at our sole discretion, temporarily throttle connection speeds, pause credit generation, or suspend access to protect system stability.

4. Acceptable use

You agree not to: misuse or attempt to overload the service; reverse engineer or tamper with the app or backend; bypass rate limits or security controls; or upload content you have no right to use. We may rate-limit, suspend, or revoke access (including via remote build expiry) to protect the service without prior notice.

5. Your Content & Privacy

You retain ownership of images and text you submit. By using the app, you grant us the limited right to process this content (including transmitting it via Google Gemini) to provide the analysis and requested features. Please refer to our Privacy Policy for detailed information on how we collect, use, and protect your data.

6. Intellectual property

The app, its design, text, and code are owned by the developer. These Terms do not grant you any rights to our trademarks, branding, or intellectual property.

7. Disclaimers & limitation of liability

To the maximum extent permitted by law, Lafai is provided without warranties of any kind. The developer is not liable for any indirect, incidental, special, or consequential damages arising from your use of this software, including but not limited to health outcomes resulting from AI analysis.

8. Changes to Terms

We reserve the right to update these Terms at any time. We will notify users of significant changes within the app. Your continued use of Lafai after changes constitutes your acceptance of the revised terms.

9. Notice Regarding App Store Providers (Apple & Google)

If you downloaded Lafai from the Apple App Store or Google Play Store (the "App Store Provider"), the following terms apply:

• Acknowledgement: You and Lafai acknowledge that these Terms are concluded between you and Lafai only, not with the App Store Provider. Lafai, not the App Store Provider, is solely responsible for the App and its content.
• Scope of License: The license granted to you for Lafai is limited to a non-transferable license to use the App on a device that you own or control as permitted by the App Store Provider’s usage rules.
• Maintenance and Support: Lafai is solely responsible for providing maintenance and support. The App Store Provider has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
• Warranty: Lafai is solely responsible for any product warranties. In the event of any failure of the App to conform to any applicable warranty, you may notify the App Store Provider, and they will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, the App Store Provider will have no other warranty obligation whatsoever.
• Product Claims & IP Infringement: Lafai, not the App Store Provider, is responsible for addressing any claims by you or any third party relating to the App, including product liability claims, consumer protection claims, and claims of intellectual property infringement.
• Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-Party Terms: You must comply with applicable third-party terms of agreement when using the App (e.g., your wireless data service agreement).
• Third-Party Beneficiary: You and Lafai acknowledge and agree that the App Store Provider, and its subsidiaries, are third-party beneficiaries of these Terms, and that the App Store Provider will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
